Article 1: Definitions
1.1 'i-vintage' (the 'seller') is a trade name and domain name from Impression, a company registered under number 17071888 at the Chamber of Commerce in Utrecht, The Netherlands.
1.2 A 'customer' is any visitor (a natural person and/or a legal entity) of the store at i-vintage.com or i-vintage.nl, placing orders.
Article 2: Applicability
2.1 These Terms & Conditions apply to all orders on i-vintage.
2.2 By placing an order, the customer accepts the applicability of these Terms & Conditions.
2.3 These Terms & Conditions can be amended any time by i-vintage.
Article 3: Agreement
3.1 An order is final once the customer has paid for it (product price, applicable payment costs, taxes, insurances, shipping costs) and from the moment the funds are on seller's account.
3.2 Ordering via the Buy now button does not guarantee availability at the moment we receive your payment.
3.3 It is not possible to make reservations.
3.4 In case the funds are not on our bank or PayPal account within 72 hours after your purchase order, we have the right to either collect the outstanding amount or to cancel the order.
3.5 In case seller is not able to deliver the item, the customer is entitled to a full refund, including all additional costs (product price, applicable payment costs, taxes, insurances, shipping costs). However, there is no right to any other form of compensation.
Article 4: Privacy
4.1 We collect personal information from customers in order to process the agreement, payment and shipping of items.
4.2 The personal information may be used for website analytics and marketing by the seller.
4.3 i-vintage may and will not share or sell personal information to other parties than strictly necessary for the purchase.
Article 5: Products
5.1 i-vintage sells used (vintage) objects. The objects often have traces of use or damages. We describe the condition of items and show photographs. In case you as our customer have any questions, please ask for additional information prior to your order.
5.2 If the product you receive is clearly different than stated on our website, please contact us so we can fix our mistake.
Article 6: Prices and Payments
6.1 All prices are in Euro's (€).
6.2 All item prices exclude additional costs such as applicable payment costs, taxes, insurances and shipping costs.
6.3 All items are vintage and as such regulated in the tax 'margin scheme'. This means that stated prices include V.A.T. on our profit only, not on the full item price. By Dutch law, the costs breakdown may not be specified on the invoice.
6.4 i-vintage reserves the right to change prices at any time for any reason.
6.5 Special offers like discounts are only valid during the period marked as such on the website.
Article 7: Delivery
7.1 i-vintage ships worldwide from our location in The Netherlands. Standard shipping is by Post NL, the national Dutch post company.
7.2 High value or large items can be shipped via DHL at prior request and additional costs.
7.3 Items will be sent by insured and registered mail, for which you have to sign at arrival.
7.4 The risk of damages and/or proper delivery is at i-vintage until the moment of handover to the shipping company.
7.5 The customer is liable for any permit, V.A.T., duties and custom or import charged at his/her country.
Article 8: Copyright
8.1. All users - customers included - of the website acknowledge the copyright i-vintage has on it's texts, descriptions and photographs. None of these may be used or duplicated in any way without prior written permission by i-vintage.
Article 9: Liability and Force Majeure
9.1 If one or both parties are hindered due to circumstances out of his/her control, Force Majeure, this party/these parties are not obliged to fulfil it's obligations.
9.2 If the Force Majeure period takes more than 30 days, each party is entitled to terminate the agreement without any obligation to pay damages to the other party.
9.3 i-vintage is only liable for damages directly related to the items, caused by it's fault or by negligence, or caused by circumstances that are under its risks.
9.4 Compensation for damages or for any other reason can never be higher than the invoice amount.
Article 10: Applicable law and competent court
10.1 On all transactions, rights, agreements and business related issues, Dutch law applies. The competent court is the District Court in Utrecht, The Netherlands.
